Terms of Service
The rules for using ClinicalVitals, including what you may and may not do with our content. Read them alongside our Disclaimer, which forms part of these terms.
Agreeing to these terms
These terms are an agreement between you and ClinicalVitals. By creating an account, buying a pass, or using any part of the site, you agree to them. If you do not agree, do not use ClinicalVitals. Our Privacy Policy explains how we handle your information.
Your account is for you alone
You must be 18 or over to use ClinicalVitals. An account belongs to one person. You may not share your login, sell or transfer your account or pass, or let anyone else sit stations on it. We monitor for shared accounts, and if we find that an account is being shared, we will close it without a refund. You are responsible for everything done through your account, so keep your password to yourself.
Passes, payments and refunds
Payments are taken by Stripe; we never see your card details. A pass gives you access to the features described on the pricing page for the period stated there. Refunds follow the Australian Consumer Law. We do not give refunds for a change of mind — for example, because you passed early, no longer need the pass, or bought the wrong one. But our services come with guarantees that cannot be excluded under that law: if there is a major failure — the service is not as described, not fit for its purpose, or not supplied with due care and skill — you are entitled to a refund or another remedy. If the failure is minor, we will fix it within a reasonable time, and if we cannot, we will refund you. Nothing in these terms limits any rights you have under the consumer law of the country you live in.
Our content is ours — do not copy it
Every station, case, patient script, examiner prompt, marking rubric, model answer, piece of feedback, blog post and other material on ClinicalVitals is the intellectual property of ClinicalVitals and is protected by copyright. We license it to you for your own personal exam preparation, and for nothing else. You must not copy, reproduce, download, screenshot, photograph, record, transcribe, summarise or reword our content in order to share it; post it to any study group, forum, chat, social network, messaging app, file-sharing site or shared drive; sell, rent or give it away; compile it into a question bank, recall document or course of your own; use it to train or prompt any AI model; or use bots, scrapers or any automated means to collect it. Sharing a few stations "just with my study group" is still copying, and is still prohibited.
What happens if you copy our content
We take copying seriously and we actively look for our material outside ClinicalVitals. If we find that you have copied or shared our content, we will immediately suspend or permanently close your account without a refund, and block you from opening a new one. We will send takedown notices to any platform hosting the copied material. We also reserve the right to take legal action against you for copyright infringement and breach of these terms, including seeking damages, an account of your profits, an injunction, and our legal costs. You agree that you are liable for any loss we suffer as a result of your copying.
Using the service fairly
Do not try to break, overload, reverse engineer, or get around the limits or security of ClinicalVitals, or access anything you have not paid for. Do not abuse the AI patients, examiners or our reviewers, or use the service for anything unlawful. We may suspend or close an account that breaks these rules.
Practice only, and the limits of our liability
ClinicalVitals is practice software. It is independent of the Australian Medical Council and every other examining body, it cannot guarantee you a result in the AMC Clinical Examination, and nothing on it is medical advice — our Disclaimer page sets this out in full and forms part of these terms. To the extent the law allows, we are not liable for any indirect or consequential loss, including exam fees, lost income or lost opportunity, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. This does not exclude any guarantee or right that the law says cannot be excluded.
Changes and ending the agreement
We may update these terms as the service changes. The version date below tells you when they last changed, and continuing to use ClinicalVitals after a change means you accept the new terms. You can stop using the service at any time. We may suspend or end your access if you break these terms; the copying clauses above survive the end of this agreement.
Governing law and contact
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts. Questions about these terms? Use the contact button in the corner of any page.
